Suit Over Estate Of Rushford Man Taken From Jury
Settlement Made to Give Widow of Ambrose Eggen $1,302.23. Preston, Minn. —(Special to The Republican-Herald)— Settlement of the estate of the late Ambrose I. Eggen, one of four Rushford brothers engaged In the automobile, gasoline, oil and farm implement business, was taken from the Jury In district court here today by Judge Norman E. Peterson and accomplished by the court following a lengthy discussion between the Judge and attorneys for both sides in the suit over the estate. Under the terms of the settlement Mr. Eggen's wife Is to receive $1,302.23, to be paid "severally and Jointly" by Eggen's brothers, C. A., Dan E. and Edgar Eggen, partners In the J. Eggen & Sons firm. The matter was brought to district court for settlement in two cases but they were tried Jointly. One was an appeal from a probate court decision regarding the division of the deceased Eggen brother's share of the business and other property. The three brothers were appellants and Alfred J. Eggen, an administrator of the estate of Ambrose I. Eggen, was the respondent. Clarence Hengel and H. M. Lamberton, Jr., were counsel for the respondent and Henry A. Larson and Philip B. Gartner of Preston represented the appellants. Sought Share, The other case was a suit brought by the administrator of the estate of the dead brother against the other three for the recovering of a share of the value of the business. Ambrose Eggen died in 1932, leaving his wife and six small children, without making a will and the process of probating his estate is now going on in the county. It was brought out in the trial that no records of the partnership between the brothers were kept and there appeared to be no agreement in writing or any partnership. Most of the evidence in the case was heard Monday and during most of the morning today the attorneys and Judge Peterson conferred regarding a settlement, going back into the history of the business for 17 years.
